Article 1 – General
1. V. Tabone Travel Limited ("VTT") acts solely as a booking agent and reseller for excursions, tours, cruises, transfers and other travel services operated by independent suppliers.
2. By making a booking, the customer acknowledges and accepts these Terms and Conditions.
3. The contract for the operation of the excursion, tour, cruise, transfer or activity is between the customer and the supplier operating the service.
4. VTT shall not be responsible for the operation of any excursion, including transport, vessel operation, routing, embarkation, disembarkation, guiding services, catering or other services provided by third-party suppliers.
Article 2 – Liability
1. VTT acts only as agent and shall not be liable for any loss, damage, accident, delay, injury to persons or property, cancellation, irregularity, inconvenience, expense or consequential loss arising directly or indirectly from any excursion, tour, transport service or activity, however caused.
2. VTT shall not be liable for the acts, omissions, negligence, default, insolvency or failure of any supplier, carrier, vessel operator, guide, restaurant, attraction or other service provider.
3. To the maximum extent permitted by law, VTT's liability in respect of any claim whatsoever shall be limited to the price paid for the excursion or service concerned.
Article 3 – Excursion Inclusions
1. Entrance fees, ferry tickets, lunches and other services are included only where specifically stated in the excursion description or booking confirmation.
2. Any item not specifically stated as included shall be deemed excluded.
Article 4 – Pick-ups, Check-in and Departures
1. Pick-ups are operated from major hotels and designated meeting points only.
2. Customers must be present at the designated pick-up location at least 10 minutes before the communicated pick-up time.
3. Customers must ensure that they are available and contactable using the telephone number provided during the booking process.
4. Failure to be present at the designated pick-up location at the required time may result in the departure of the transport without the customer. No refund or compensation shall be payable in such circumstances.
5. If transport has not arrived within 10 minutes of the communicated pick-up time, customers should contact VTT immediately using the emergency contact details provided.
6. Customers must verify that their name appears on the driver's passenger list before boarding.
7. Customers are responsible for ensuring that they board the correct vehicle, vessel or excursion. VTT shall not be liable for any loss, delay, missed excursion or additional expense arising from a customer's failure to board the correct transport or excursion.
Article 5 – Meeting Points and Return Departures
1. Customers are responsible for being present at all designated meeting points at the times communicated by the guide.
2. Failure to arrive at a designated meeting point at the communicated time may result in the departure of the transport or vessel without the customer.
3. In such circumstances no refund, compensation or alternative transport shall be provided and any additional costs incurred shall be borne solely by the customer.
Article 6 – Boat Excursions and Weather Conditions
1. Boat excursions and sea-related activities are subject to weather and sea conditions.
2. Routes, departure points, arrival points and itineraries may be changed by the operator for safety or operational reasons.
3. VTT shall not be liable for cancellations, delays, route changes or alterations resulting from rough seas, adverse weather conditions or decisions taken by the vessel operator.
4. Any refund, rescheduling or compensation for weather-related cancellations shall be subject to the terms and conditions of the operating supplier.
Article 7 – Dress Code and Places of Worship
1. When visiting churches, cathedrals and other places of worship, guests are required to dress respectfully.
2. Guests may be required to cover their shoulders and avoid excessively short shorts, skirts or other clothing considered inappropriate by the site authorities.
3. Entry to religious sites remains at the discretion of the site authorities.
Article 8 – Personal Belongings
1. Customers are responsible for their personal belongings at all times.
2. Before leaving any vehicle, vessel, restaurant or attraction, customers should ensure that all personal belongings have been collected.
3. Whilst every effort will be made to assist in locating lost property, VTT and its suppliers cannot guarantee recovery of any item and accept no responsibility for loss, theft or damage to personal belongings.
Article 9 – Customer Responsibilities
1. Customers are responsible for reading all booking confirmations and communications issued by VTT.
2. Customers must follow all instructions provided by VTT, guides, drivers, vessel operators and other authorised representatives.
3. VTT shall not be liable for missed departures, boarding errors, delays, denied boarding or additional costs arising from a customer's failure to follow instructions or communications provided by VTT or the supplier.
Article 10 – Complaints
1. Any operational issue, including boarding, transport, guiding services, food and beverage service, itinerary changes, facilities or other matters affecting the excursion, must be reported immediately to the supplier, guide, driver or service provider during the excursion.
2. Customers must allow the supplier a reasonable opportunity to investigate and remedy the issue whilst the excursion is taking place.
3. If the issue cannot be resolved on site, the customer should contact VTT immediately using the emergency contact details provided.
4. Failure to report an issue during the excursion may affect the ability of VTT and/or the supplier to investigate the matter or provide any remedy.
5. Any complaint not satisfactorily resolved during the excursion must be submitted in writing to VTT within fourteen (14) days of the excursion date.
6. A clearly specified account of the complaint together with any supporting documentation shall be provided.
Article 11 – Force Majeure
1. VTT and its suppliers shall not be liable for failure to perform their obligations where such failure is caused by circumstances beyond their reasonable control, including but not limited to adverse weather, rough seas, natural disasters, strikes, industrial disputes, government action, traffic disruption, civil unrest, accidents or force majeure events.
Article 12 – Governing Law
1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Malta.
2. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the jurisdiction of the Maltese Courts.
